49ers investigate Smith’s alleged drinking with McDonald

The San Francisco 49ers are checking into a report that Aldon Smith was with Ray McDonald at his house the day after McDonald is alleged to have committed a sexual assault, general manager Trent Baalke said Monday.

A search warrant affidavit released by the court Monday indicated that Smith was drinking with McDonald and the alleged victim at McDonald’s house Dec. 15 — after the alleged assault occurred Dec. 14. Smith is not being investigated for any alleged crime.

Smith missed five games last season while receiving voluntary treatment for alcohol abuse, and he was suspended for nine games to start this season for violations of the NFL’s policies on substance abuse and personal conduct.

Baalke told 95.7 The Game on Monday that he had not read the affidavit.

“I don’t know at what point he was involved — at the house, not at the house,” Baalke said. “I have not gotten all the facts. When we do, we’ll make a decision on what we want to do.”

The 49ers picked up Smith’s $9.745 million option for 2015, but the salary is not guaranteed unless he is on the roster March 10.

McDonald was released last Wednesday after the 49ers discovered he was the subject of the assault allegation. McDonald has not been charged, although the investigation is continuing. Baalke cited McDonald’s “pattern of poor decisions” for the decision to release him. McDonald was investigated for domestic violence earlier this season, but he was not charged.
